CFTC launches legal action against Utah over prediction market oversight
The Commodity Futures Trading Commission has sued the state of Utah to stop local authorities using state laws to shut down federally registered event contract operators.

- The CFTC took legal action against Utah on 27 October 2026, marking its tenth federal action against a state over event contract regulation.
- The lawsuit responds to Utah bringing civil enforcement proceedings in state court against CFTC-regulated prediction markets and other commercial businesses.
- The federal regulator has now initiated proceedings against ten states and submitted briefs in five appellate and state supreme courts.
The Commodity Futures Trading Commission has widened its nationwide legal fight over jurisdiction in the prediction markets sector, filing a federal lawsuit against the state of Utah.
Lodged on 27 October 2026, the federal legal action seeks to prevent Utah authorities from applying state-level legislation to shut down federally registered prediction and event contract markets operating within its boundaries.
The intervention represents the tenth federal action the CFTC has initiated against an individual US state regarding the regulation and supervision of event contracts.
State-level civil enforcement prompted federal response
The CFTC stated that its lawsuit came in direct response to a decision by Utah authorities to pursue civil enforcement actions in state court against trading platforms and markets that are already subject to federal regulation by the commission, as well as against other commercial businesses.
Explaining the decision to mount the legal challenge, CFTC Chairman Michael S. Selig criticised the scope of the state's enforcement measures against operators in the sector.
Utah seeks to shut down prediction markets across a wide variety of markets.
Despite the publication of an official announcement confirming the legal action against Utah, the regulatory release did not disclose which specific court the lawsuit was filed in. The commission also did not specify in the release what precise legal remedies or judicial relief it seeks against the state.
Broader multi-state jurisdictional clashes
The federal lawsuit follows earlier legal hostility between Utah officials and market participants. The attorney general of Utah had previously filed a lawsuit against prediction platform Kalshi in an attempt to shut down sports and election betting inside the state.
Litigation between regulators and market operators has also arisen in other US jurisdictions. In an unrelated action, commercial operators Crypto.com and Novig filed a lawsuit against the state of Missouri to prevent state-level enforcement from being carried out against sports event contracts.
Federal brief submissions and market integrity
The filing against Utah deepens an expansive multi-jurisdictional defensive effort by the federal regulator. As of 27 October 2026, the CFTC had initiated proceedings against nine other states alongside Utah. The commission had also submitted formal legal briefs in four federal courts of appeal and one state supreme court to assert its statutory authority.
The court proceedings in Utah follow a separate policy focus signalled by the regulatory agency regarding the integrity of trading on event platforms. Exactly one day prior to filing the Utah lawsuit, the CFTC formally identified insider trading within prediction markets as a key enforcement priority.
